INTRODUCTION
These Terms of Service (the “Terms”) are applicable for users with a Sellpy profile ("Profile"). “You” means You as a customer when You register for and use an Profile. Unless otherwise stated in any additional terms, Your Profile is provided by Sellhelp AB ("Sellpy") Reg. No. 556996-1260, registered address Götgatan 74, 118 26, Stockholm, Sweden.
REGISTERING FOR A PROFILE
A Profile will allow You to sign in to sellpy.com and see an overview of your previous purchases or sales when logged in to Your Profile and to store payment and delivery information.
By registering for a Profile, You confirm that You are at least 18 years of age and not under guardianship, or that you have the consent to register for a Profile from Your parent(s), guardian or legal representative as applicable, that the information You provide is true and accurate and that You agree to these Terms. Additional terms will apply for purchases and/or any supplementary services You access through Your Profile. The Profile is free of charge and no purchase is necessary to register for a Profile.
In order to register a Profile, You need to provide us with a valid email address and choose a valid password. We only allow one (1) registered Profile per user and email address.
The log in details will be kept and managed by the Sellpy group of companies. You can find information about how the Sellpy group will process Your personal data when registering and using Your Profile in the Privacy Notice.
USING THE PROFILE
Your Profile will be available from the time You receive a confirmation that the Profile has been successfully registered.
When using Your Profile it is forbidden to engage in any illegal or otherwise harmful activity. Further, it is forbidden to circumvent, or attempt to circumvent, any restrictions on use of, or availability to, the services. It is also forbidden to assist others in engaging in such activity. By agreeing to these Terms, You agree to adhere to the rules governing the use of Your Profile.
To keep Your Profile safe, make sure that You keep Your Profile information, including information of Your user name and password, confidential. You are responsible for all activity that is conducted by You on your Profile.
Your Profile will be active until it is terminated by either You or Sellpy. You may terminate Your Profile at any time, and for any reason, through Your Profile settings on sellpy.com or by contacting Customer Service. If Your Profile is terminated, irrespective of by You or by Sellpy, Your access to the Profile will cease immediately.
If You are proven or reasonably assumed to be in violation of these Terms, we have the right to terminate Your Profile without any prior notice to You and we reserve the right to refuse or terminate any new accounts, You are found to possess or attempt to register in the future.
LIMITATION OF LIABILITY
Your Profile is provided as is. Sellpy does not warrant that (i) the Profile will meet Your requirements or expectations, (ii) the results that may be obtained from the use of the Profile will be accurate or reliable, (iii) any errors in the Profile will be corrected.
The functionality of, and the services available in, Your Profile may vary from time to time and may be dependent on Your country or region. Sellpy makes no warranties, except for those expressly provided for in law, for the non-interrupted access to Your Profile or the services made available through the profile. Any new, changed, or removed features of the Profile are subject to these Terms. Sellpy will not be liable for any system failure or malfunction of Your Profile or any consequences thereof. Sellpy accepts no liability for any loss or damages arising from suspension, variation or termination or in any other way relating to the Profile, except for any liability which cannot be excluded by law.
MODIFYING THE TERMS
Sellpy may, at its sole discretion, terminate, alter, limit, suspend or modify the Terms for Your Profile at any time in case of changes to applicable laws, changes in services provided by us or when introducing new services, without prior notification to You, provided that these changes do not negatively affect the use of the Profile. In case of other changes, You will be given prior notification via email, in-app information or via the website sellpy.com or a combination of these. Please make sure to stay updated on these Terms of Service for Profile. You will always find the latest version of these Terms on sellpy.com
SEVERENCE
If anything in these Terms is found to be unenforceable for any reason, this will not affect the enforceability of any other terms.
APPLICABLE LAW AND JURISDICTION
These Terms are governed, interpreted and applied in accordance with the laws of Sweden. However, if You are a resident of another country or region than Sweden, these Terms can be subject to mandatory consumer protection laws and regulations in force in Your country of residence which may provide You additional rights.
